Yes, every retailer must legally ensure that there are no safety hazards on their property. Keeping their customers safe, should on the top of every retailers list, but unfortunately it is not.

You can slip and fall from broken products, liquid spills, and uneven flooring if not taken care of immediately. You might even suffer serious injuries like- head injuries, broken bone, or spinal cord damage. Here’s what you need to know if you are injured from of a slip and fall-

Who is Liable For Slip and Fall Accidents

Property owners must maintain safe conditions on their properties so visitors are safe and not harmed and if they don’t and they have been negligent, they will be liable for any injuries incurred.

But it is not automatic … you must prove one of the following–

  • The property owner knew of the unsafe condition but did not fix it in a timely manner.
  • The property owner created the unsafe condition, and did not fix it in a timely manner.
  • No one knew about the unsafe condition, but a reasonable property owner would have.

Some retailers rent their space from a property owner, some own their retail space. If a retailer does not own the property, both the retailer and the property owner could be held liable for slip and fall injuries. Your attorney will need to figure out who knew about the hazard and who was responsible for fixing it.

On the other hand, a retailer is solely responsible for any hazards that exist if they are not related to the building’s structure, like, if goods fall off of a shelf and causes you to trip and fall. Obviously a property manager is not liable for a retailer’s negligence.

First thing is of course to seek medical attention for your injuries. You can do this by- calling 9-1-1 immediately if you need it, or visiting a doctor as soon as possible. Then-

  • Take photos
  • Gather other evidence before leaving the accident.
  • Talk to witnesses and ask for their contact information.
  • Check to see if there any surveillance cameras aimed in your direction.
  • You must also make certain that the store’s owner is well aware of what occurred.
