Can I Sue Philips CPAP Machine?

Why Were Philips CPAP Machines Recalled?

On June 14, 2021, Philips issued a recall on certain CPAP devices due to rising concerns about the health risks encountered while using the products. Philips manufactured the recalled machines between 2009 and April 2021. 

After the U.S. Food and Drug Administration (FDA) publicly alerted users and health care providers about the CPAP machine recall, the Philips manufacturing facility was inspected in August 2021. The FDA determined that the polyester-based polyurethane (PE-PUR) foam used in certain CPAP machines, as well as ventilators and BiPAP machines, was defective. The foam was originally placed in the devices to reduce sound. 

The breakdown of the defective foam caused debris to enter the air pathway of the machines – where, unfortunately, machine users inhaled the potentially hazardous debris. In some cases, the side effects of inhaling this toxic debris were severe and potentially life-threatening.

What Philips Machines Were Recalled?

Not all Philips CPAP machines were part of the recall. In all, 20 Philips products were deemed unsafe – 13 of them were CPAP and BiPAP devices, while the other seven were ventilators. 

The recalled machines include:
