What Does Workers’ Compensation Cover?

Workers’ compensation benefits cover the following:

Medical Care

Your employer’s workers’ compensation policy should cover all required medical treatment, which could include hospitalization, surgeries, prescriptions, physical therapy, chiropractic services, and more.

Lost Wages

Workers’ compensation policies cover a portion of your lost wages for the time you are unable to work. Depending on the severity of your injury, you may be entitled to either temporary or permanent disability.

Temporary disability benefits are available if you are unable to work for at least three days following your injury or illness diagnosis. You can recover two-thirds of your lost wages until you are able to return to work or until your injury or illness becomes “permanent and stationary.”

Permanent disability benefits are available if your injury or illness results in “permanent impairment.” Your percentage of lost wages depends on the following:

  • The severity of your injury or disfigurement
  • Your age when you were injured
  • Your occupation
  • When you were injured
  • How much of the injury is a result of work versus other factors (i.e., apportionment)
  • Your lost earning capacity

The insurer will use a formula that considers all these factors. The formula is complex, but the KJT Law Group workers’ compensation attorneys in Ventura can explain how it works.

Supplemental Job Displacement Benefit

You can also recover a voucher for retraining and/or skill enhancement, which can cover things like tuition, books, and tools.

Return-to-Work Supplement Program

You can recover a one-time payment that covers a “loss of earnings that is disproportionate to their permanent disability ratings.”

Death Benefits

If you lost a loved one due to a work-related injury or illness, you can receive death benefits, which include payment for reasonable burial expenses and support payments.

Can I Sue My Employer for My Injury?

Workers’ comp doesn’t cover everything.

While you likely can’t sue your employer for your injuries, you may be able to sue a third party that caused or contributed to your injury, such as a manufacturer, another party on site, a property owner, or another driver. Our personal injury lawyers can help you identify the liable party and build a case holding them responsible for your injuries. To do so, we typically must establish the following:

  • The other party owed you a duty.
  • They breached that duty.
  • Their breach caused your injury.
  • You sustained damages.

How Long Do I Have to Take Action in a Workers’ Comp Claim?

There are several deadlines you need to be aware of in a workers’ comp claim. Two of the most important include:

  • You must report your injury to your supervisor within 30 days.
  • You must file a workers’ compensation claim within one year.
