What Is Long-Term Disability?

Long-term disability, or LTD, is a type of insurance coverage that protects workers who may become partially or totally disabled, leaving them unable to work and earn a living for themselves or their families. In some cases, employers provide LTD insurance for their employees, but this is not mandatory. You can elect to purchase an individual LTD insurance policy if your employer does not offer this type of coverage.

If you do not have LTD coverage, either through your employer (or another form of group coverage) or your own policy, you may be able to qualify for Social Security Disability Insurance (SSDI) benefits or Supplemental Security Income (SSI). You may also be eligible for permanent partial or permanent total disability benefits through the California workers’ compensation system.

How Is Long-Term Disability Different from Long-Term Workers’ Comp Benefits?

Long-term disability is a specific type of insurance that covers lost income/wages only. Workers’ compensation benefits, on the other hand, provide compensation for lost income/wages, as well as medical expenses, job placement services, and more. If an employee suffers a job-related injury or medical condition that results in permanent impairment, whether partial or total, they may be entitled to long-term workers’ compensation benefits.

Permanent partial or total disability benefits may be available for the following types of work-related injuries and conditions:

  • Repetitive stress injuries and disorders
  • Traumatic brain injuries
  • Spinal cord injuries and paralysis
  • Amputation/loss of limb
  • Loss of hearing and/or vision
  • Severe burn injuries
  • Internal organ damage
  • Cancer
  • Mesothelioma
  • Heart or lung disease

These and other catastrophic injuries can prevent an employee from returning to work at full capacity or at all. Depending on the worker’s “impairment rating” (as determined by their treating physician), they may be entitled to permanent partial disability (PPD) or permanent total disability (PTD) benefits for the remainder of their life. Individuals who receive an impairment rating between 70 and 99% are also entitled to a life pension benefit through the workers’ compensation system on top of PPD benefits.

Do Long-Term Disability Benefits Offset Other Benefits?

While you typically cannot receive both workers’ compensation benefits and state-funded short-term disability benefits at the same time, filing for long-term disability benefits does not necessarily prevent you from also recovering compensation through other benefits programs, such as workers’ compensation and Social Security disability. However, if you receive LTD benefits, your other benefits will be “offset.” This simply means that your LTD benefits will likely be reduced by the amount you are receiving through other benefits programs.

How Long Can You Receive Long-Term Disability Benefits?

The specific language of your policy determines how long you can receive LTD benefits. However, these benefits most commonly last for at least one year and can continue up until retirement age (typically 65). Some LTD insurance plans offer exceptions for specific injuries, illnesses, and medical conditions, including mental health disorders.
