Are you entitled to receive financial compensation for your injuries?

So many people ask us, am I entitled to compensation for my injuries? Here are 3 questions to answer that will help you figure out your personal situation-

  • Did you suffer a personal injury or was it just property damage?
  • Were your injuries caused by another person or entity negligence?
  • Do you have recoverable damages?

Let’s dig deeper.

Did you suffer a personal injury?

First let’s define personal injury. A personal injury is an injury to your body, emotions or mind. So a personal injury does not have to be physical, it can be psychological as well.

Furthermore, if you sustained a concussion or broke your leg after slipping and falling down in a movie theatre, you have suffered a personal injury. You also have suffered a personal injury if you sustained trauma, like insomnia, severe anxiety, or depression after the accident.

A personal injury is not the same as having property damage. A fender bender with minimal damage to your auto and where you suffered no injuries to your body or psyche, is not seen as personal injury.

Were your injuries caused by the negligence of another person or entity?

To be able to have a feasible personal injury claim or lawsuit, your personal injury/injuries must be caused by negligence.  Negligence is generally defined as, “the failure to behave with the level of care deemed reasonable.”

This negligence must be caused by another person or entity like a government agency or business. If that person/entity causes injury to you, the inattentive person/entity will usually be (liable) legally responsible for those injury/injuries and any other harm that resulted harms due to “negligence.”

Do you have recoverable damages?

To be able to show recoverable damages, you must have suffered financial or personal harms that can rectified by financial damages. Damages are defined as a sum of money awarded to an injured person.

When you can prove another person/entity behaved negligently and caused you injury, the court can award you, or an insurance company can voluntarily pay you, a sum of money for-

  • Medical bills
  • Emotional suffering, physical pain, emotional suffering, and mental anguish
  • Lost Wages
  • Disability accommodations for your vehicle and home

Most of these damages are economic, while others are non-economic, such as pain and suffering and diminished quality of life. These are more difficult to measure. We suggest you consult with an experienced personal injury lawyer to make reasonable estimates.
