    How Can I Prevent a Car Accident?

    • Don’t be on your cell phone.
    • Drive defensively. Not everyone else is driving as safely as you are.

    • Make sure you are driving a safe vehicle.
    • Never drive while fatigued or intoxicated.

    What Should I Do Immediately After a Car Accident?

    There are a few things you should do to protect yourself after an accident:
    • The first thing to do after a car accident is to call 911 if anyone has been injured or if a vehicle has been badly damaged.
    • Next, check on everyone and get contact and insurance information from all motorists involved.
    • Then, if it is safe to do so, take pictures of the scene and be thorough with how many you take.
    • When the police show up, tell them what happened but don’t speculate about what the other driver was doing. Don’t apologize for the accident, even if you think that you may have caused it. Let law enforcement investigate while you receive treatment from the paramedics.
    • You should receive medical attention, even if you aren’t sure you’ve been injured. Adrenaline could cover symptoms of a serious injury; tell the paramedics about any discomfort you are feeling, no matter how minor you think it is.
    • If you don’t receive emergency treatment on scene or at the ER, you still should go to urgent care once you are able to leave the scene of the crash.

    What Information Do I Need to File a Car Accident Claim?

    To file a car accident claim , you need to know the insurance information of the other driver. A summary of your injuries will also be useful. Be prepared to also send your insurance company copies of eyewitness statements and photographs you took at the scene. We recommend that you write down what happened at the scene so you don’t forget details or accidentally contradict yourself later.

    What If the Accident Was At Least Partly My Fault?

    This is a very common question we receive. California’s pure comparative negligence rule allows you to file a claim against any party that was at least 1% liable for your car accident. You can be partly or mostly liable for the crash and still have a valid claim to file under this distinct liability rule. It is important to note that your percentage of fault will decrease the compensation you can recover, so it’s important to get help from an attorney who can build a strong case proving the other party’s liability. You want to ensure that you get every dollar you deserve, not 80% of your damage award.

    Should I Speak With the Insurance Adjuster?

    The other party’s insurance adjuster will call you in the days after the accident, asking to hear your side of the story. This is often a trap. The adjuster will see if you are okay with a recorded statement and then ask leading questions, hoping you will say something you regret. It’s very easy to jeopardize your case during this call. Even something as simple as an “I’m sorry” or “I’m okay” could ruin your case.
