Can I Recover Workers’ Compensation Benefits in California?

Chances are, you are eligible for workers’ compensation benefits. In California, nearly all employers are required by law to purchase workers’ compensation insurance, regardless of the number of employees they have. 

Workers’ comp is a no-fault system that allows injured employees to recover monetary benefits without having to prove that someone else was at fault for their work-related injuries or medical conditions. In exchange, these employees are barred from suing their employers for damages (in most cases). Workers’ compensation covers all work-related injuries, illnesses, and medical conditions. This is true whether you work part-time, full-time, or seasonally.

All employees who qualify for workers’ compensation can recover the following benefits:

Medical Benefit:

Your employer’s workers’ compensation insurance policy should cover all reasonable medical care you need for your work-related injury or illness. Covered medical care includes (but is not limited to):

There are two types of temporary disability benefits available to you:

  • Temporary partial disability: If you are partially disabled for a period of time, you can recover benefits that depend on your level of disability. You can learn more about what your benefit will be here.
  • Temporary total disability: If you are totally unable to work for a period of time, you can recover 2/3 of your AWW.

There are two types of permanent disability benefits you could recover:

  • Permanent partial disability: If you are permanently disabled, you will receive a disability rating from 1 to 99. This will determine what you receive.
  • Permanent total disability: If you are deemed 100% disabled after a catastrophic injury, you can receive lifetime disability benefits at two-thirds of your AWW.

Job Displacement Benefits

You may also qualify for a job displacement benefit of $6,000.

You may also qualify for an additional $5,000 payment per the Return to Work Supplement Program.

Disability Benefits

You can recover either temporary or permanent disability benefits, depending on the specifics of your injury. Your disability benefits are calculated at 2/3 of your average weekly wage (AWW), up to a maximum amount. Your AWW is your yearly salary divided by 52.

If you lost a loved one due to a work injury or illness, you can recover death benefits. Death benefits cover reasonable funeral and burial expenses and weekly compensation. How much weekly compensation a family is eligible for depends on how many dependents the worker had.

Can I Choose My Own Doctor?

You can choose your own doctor but there are rules you must follow to do so. The doctor who treats you must follow medical treatment utilization schedule (MTUS) guidelines. If they fail to do so, the insurer can refuse to pay for your treatment. You must also notify your employer in writing of your preference.

In some cases, you may be required to choose your care from a group of approved doctors called an MPN. You must be given a list of these doctors from which to choose.

Other rules may apply. We suggest that you call us to ensure your care is covered. After all, if it isn’t, you could be paying thousands out of pocket.

What Does SAWW Mean?

SAWW stands for Statewide Average Weekly Wage. The 2024 SAWW is $1,642.00. Changes in the SAWW affect how much you can receive for permanent total disability.

What If My Employer Doesn't Have Workers' Compensation Insurance?

Some employers don’t purchase workers’ compensation insurance. If that is the case and if your employer’s negligence caused your injuries, you can file a third-party claim against them. If another party was at fault, you can hold them liable, even if your employer purchased workers’ comp insurance.

What Do I Do If My Benefits Were Denied?
